Subject:- Eligibility for the post of Assistant Professors in Higher Education Department with reference to UGC
(Minimum Standards and Procedures for awards of M.Phil/Ph.D Degree) Regulation, 2009. Certificates regarding.

Whereas candidates, who had applied for the posts of Assistant Professors in Higher Education Department on the basis of having acquired Ph.D degrees, were informed vide Commission’s Notices dated 23.11.2015 and 14.12.2015 to submit a certificate of having been awarded Ph.D degree in accordance with UGC (Minimum Standards and Procedures for awards of M.Phil/Ph.D Degree) Regulation, 2009 as laid down in the J&K Higher Education (Gazetted) Service Recruitment Rules, 2014; and

whereas, the last date for submission of such documents was 10.12.2015; and

whereas, taking a lenient view the Commission entertained such documents even after expiry of the last date; and

whereas, most of the candidates have submitted the equivalence certificates/general certificate; and

whereas, the University of Jammu vide Notification No. DRS/15/16875 dated 31.12.2015 has withdrawn all such certificates issued in favour of the candidates:-

a) who have acquired such Ph.D degrees prior to issuance of UGC (Minimum Standards and Procedures for awards of M.Phil/Ph.D Degree) Regulation, 2009;

b) who have been issued certificates in pursuance of Thyagarajan Committee report; and whereas, the notification of the University of Jammu dated 31.12.2015 also reads as under:-

“For post June 2009 candidates, the certificates were issued on the basis of their having pursued research as per new standards.

For pre-June 2009 candidates, the certificates were issued on the basis of recommendations of Prof. S.P. Thyagarajan Committee which laid equivalence if atlteast 6 out of 11 parameters set are met by the pre-2009 candidates.” and

whereas, Jamia Millia Islamia, New Delhi has also withdrawn the certificates issued by them in this behalf on the basis of recommendations of Prof. S.P. Thyagarajan Committee Report which report stands quashed by the Hon’ble Supreme Court in the case titled P. Susila and Ors. V/s State and Ors vide order dated: 26.03.2015; and

whereas, the issue was examined in light of the above developments in the Commission and it was decided not to accept equivalence/general certificates issued by the University of Jammu and Jamia Millia Islamia, New Delhi except those which connote the awards of Ph.D Degree under UGC Regulations of 2009 which shall apply mutatis-mutandi to all the candidates having been awarded Ph.D Degree by other Universities including state universities.

Now, therefore, it is hereby notified for information of the candidates who have applied for the post of Assistant Professor in Higher Education Department on the basis of being in possession of Ph.D Degree to submit in person or through e-mail ([email protected]/[email protected]), the following documents by or before 15th January, 2016 failing which their candidature shall be deemed to have been rejected ab initio:-

i) date of registration under Ph.D programme.

ii) date of implementation of UGC (Minimum Standards and Procedures for awards of M.Phil/Ph.D Degree) Regulation, 2009 by the concerned University from where such degree has been acquired.

The above documents shall be entertained only if issued by the designated/competent authority of the concerned University.

However, for the candidates whose interview schedule has been notified from 7th to 10th January, 2016, it has been decided that in case they are not in position to submit above said documents by 10th of January, 2016 or at the time of interview may furnish an undertaking at the time of interview that they shall submit the same by 15th January, 2016 failing which their candidature shall be deemed to have been rejected ab initio.
